EU AI Act Article 50 for game developers: what to label from August 2026

Short answer: Since 2 August 2026, AI tools must mark output machine-readably, AI chat systems must say they're AI unless obvious, and deepfake-like content must be disclosed. Fictional and artistic works get a lighter, non-intrusive disclosure.

Who has to do what

AI tool vendors (providers)Mark generated audio, image, video and text machine-readably (Art. 50(2)); systems placed on the market before 2 Aug 2026 have until 2 Dec 2026. Source code is outside the marking duty.
Games with AI chat / NPCsPeople must be told they are interacting with AI unless it is obvious (Art. 50(1)).
Studios publishing AI content (deployers)Disclose deepfakes: AI images, audio or video that resemble existing people, objects, places or events and would falsely appear authentic (Art. 3(60), 50(4)).
Artistic and fictional worksDisclosure "in an appropriate manner that does not hamper the display or enjoyment of the work".

Official text

"Some deepfakes are part of evidently artistic, creative, satirical, fictional or analogous works or programmes. For these, the transparency obligation is limited to the disclosure of the deepfake content in an appropriate manner that does not hamper the display or enjoyment of the work."

"Article 50 of the AI Act applies as from 2 August 2026."

FAQ

Does the EU AI Act apply to indie games?

Article 50 transparency duties apply from 2 August 2026 to deployers using AI systems professionally. A game that shows AI-generated deepfake-like content (realistic people, places or events that could pass as real) must disclose it; evidently artistic or fictional works may disclose in a way that doesn't hamper enjoyment.

Do AI NPCs need a disclosure?

Providers of AI systems that interact directly with people must make clear the person is talking to an AI unless it is obvious to a reasonably well-informed person (Art. 50(1)). In a game where AI characters are evidently part of the fiction, check the Commission guidelines for whether this is 'obvious'.

Do I have to label AI art made before August 2026?

No: the Commission FAQ says content generated before 2 August 2026 doesn't need retroactive labelling, though it encourages it.

What are the fines?

Up to €15 million or 3% of worldwide turnover, with proportionality for SMEs (Commission FAQ, 24 July 2026).
