Can I copyright a game made with AI?
Short answer: Mostly yes, for the parts people made. In the US, copyright doesn't cover purely AI-generated material, but your code, writing, level design, creative edits, and the selection and arrangement of AI assets can be protected. Japan and South Korea take similar positions. The UK still protects 'computer-generated works' but has proposed removing that. So a game is usually protectable as a whole, while a single raw AI image in it may not be.

What the official terms say
"Copyright does not extend to purely AI-generated material, or material where there is insufficient human control over the expressive elements."
"if AI is used as a "tool“ by a person to creatively express thoughts or sentiments, such material is considered a “work”, and the user of the AI the “author”."
"Since a work must express human ideas or emotions, an output created mechanically by GenAI rather than a human does not qualify as a copyrighted work."
"In the case of a general purpose AI which generates output in response to a user prompt, the “author” will usually be the person who inputted the prompt."

What it means for your game
- Protected (usually): code you wrote, story and dialogue you wrote, level and systems design, and your creative changes to AI output.
- Not protected (US, Japan, Korea): AI output made from prompts alone, without human creative control.
- UK: computer-generated works are still protected for 50 years, but the government proposed removing this on 18 Mar 2026.
- What to keep: a record of which assets are AI-made, the tool and plan, and what you changed.
- Separate question: whether you may sell the assets depends on the tool's licence, not on copyright.
Copyright where you sell
- United States: purely AI output not protected. Purely AI-generated material is not protected. Human-authored parts, creative selection/arrangement and creative modifications of AI output can be. The Supreme…

FAQ
Can I copyright a game that uses AI art?
The game as a whole, yes: the code, writing, design and your arrangement are human work. In the US, purely AI-generated images inside it are not protected on their own.
Is AI art copyrighted?
Not in the US, Japan or South Korea when it is made without human creative control. The UK still has a computer-generated works rule. China's Beijing Internet Court protected one AI image because of the user's creative input.
Can I still sell a game if parts aren't copyrightable?
Yes. Copyright decides whether others can copy those parts; selling depends on your tool licences and store rules.
