Does itch.io require AI disclosure?
Short answer: For game assets, yes. itch.io made the generative AI disclosure field required for all asset creators and enforces it strictly: untagged AI assets can lose browse indexing. For games, itch.io asks you to tag accurately in the AI Disclosure section of your project's edit page. Classic game AI such as pathfinding or self-contained procedural generation needs no tag.

What the official terms say
"We ask that you accurately tag your project if it contains materials produced by generative AI by utilizing the AI Disclosure section on your project's edit page."
"we are strictly enforcing disclosure for all game asset pages due to legal ambiguity around rights associated with Generative AI content. Failure to tag your asset page may result in delisting."
"Projects using self-contained algorithms without external large datasets don't require the use of generative AI tags."
"This field is now required for all asset creators on itch.io."

What it means for your game
- Selling assets (sprites, music, 3D packs): fill in the AI disclosure. It is mandatory.
- Publishing a game: tag it if it contains generative-AI material. itch.io asks for accurate tagging.
- AI coding help: the guidelines target 'materials produced by generative AI'. We found no itch.io wording about AI-assisted code specifically, so tag the game if AI-written code ships in it and you want to be safe (our suggestion, not an itch.io rule).
- Procedural generation: algorithms that don't rely on external large datasets don't need the tag.
- Your tool licence still applies: itch.io's tag doesn't make a non-commercial free-tier asset sellable.
Store rules
| Store | AI disclosure | Summary |
|---|---|---|
| itch.io | Required for assets you sell/publish | Asset pages must complete the Generative AI disclosure (untagged AI assets lose browse indexing). Games are asked to tag accurately; classic game AI (pathfinding, procedural generation) needs no tag. |
| Steam (Valve) | Required (pre-generated and live AI) | Disclose AI content that ships and is consumed by players (pre-generated), and describe guardrails for live-generated AI. Efficiency tools used during development are not the focus. |
| Fab (Epic asset marketplace) | Required for assets you sell/publish | Publishers must mark assets made with generative AI as 'Created with AI' at publish time; misclassifying violates Fab terms. Buyers can hide Created-with-AI results. A separate NoAI tag opts an asset… |
| Godot Asset Store | Required for assets you sell/publish | AI-generated assets and code are allowed if you disclose what is AI-generated and how AI was used, including AI output you edited or embedded in human-made work. |
